Terms of Use

By downloading, installing, or using Learn Vietnamese: Saigon ("the App"), you agree to these Terms of Use. If you do not agree, please do not use the App.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices you own or control, subject to these Terms and the Apple Media Services Terms and Conditions.

2. Account & Access

You do not need to create an account to use the App. Some features (AI photo import) require an internet connection. Subscription features are managed through your Apple ID.

3. Subscriptions & Purchases

The App offers a free trial, yearly subscription ($49.99/year), and lifetime purchase ($149.99).
Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel subscriptions in your Apple ID account settings.
Any unused portion of a free trial is forfeited when you purchase a subscription.

4. Content & Intellectual Property

All content in the App — including vocabulary data, audio recordings, lesson text, illustrations, and the city map — is owned by Kevin Davis or licensed to us. You may not copy, redistribute, or commercially exploit any App content.

5. User-Generated Content

When you use the AI photo import feature, you retain ownership of your photos. Photos are processed on our server and automatically deleted within 1 hour. We do not claim rights to your photos or the flashcards generated from them.

6. Acceptable Use

You agree not to:

Reverse-engineer, decompile, or disassemble the App
Use the App for any unlawful purpose
Attempt to circumvent subscription restrictions
Redistribute App content or audio files

7. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not guarantee that the App will be error-free, uninterrupted, or that all content is perfectly accurate.

8. Limitation of Liability

To the maximum extent permitted by law, Kevin Davis shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of California, United States.
