Terms of Use

By downloading, installing, or using Learn Vietnamese: Saigon ("the App"), you agree to these Terms of Use. If you do not agree, please do not use the App.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices you own or control, subject to these Terms and the applicable Apple App Store or Google Play terms.

2. Account & Access

You do not need to create an account to use the App. Some features (AI photo import) require an internet connection. Store purchases are managed through the Apple ID or Google Play account used to make the purchase.

3. Subscriptions & Purchases

The App offers monthly and yearly subscriptions, a one-time lifetime purchase, and optional word-pack and photo-credit purchases. Paid access is required for the main learning content.
Your store displays the applicable local price, billing period, trial eligibility, trial duration and renewal terms before you confirm a purchase. Offers and availability may vary by account and region.
Android payments are processed by Google Play; iOS payments are processed by Apple's App Store. We do not receive your payment-card details.
Subscriptions renew automatically unless canceled before renewal. For Apple subscriptions, turn off auto-renewal at least 24 hours before the end of the current period; Apple may charge for renewal within the preceding 24 hours.
Manage or cancel Android subscriptions in Google Play → Profile → Payments & subscriptions → Subscriptions, or Google Play's subscription manager. Manage Apple subscriptions in your Apple ID account settings.
If a free trial applies, the subscription renews at the displayed price after the trial unless canceled in time. Apple's rules may forfeit any unused trial when you purchase a subscription.
Uninstalling the App or deleting your app account does not cancel a store subscription. Buying lifetime access also does not automatically cancel an existing subscription; cancel it separately to stop future renewals.
Photo credits are consumed when used. Word packs are add-ons, not a substitute for the main subscription or lifetime access. Included packs and credits are described on the purchase screen.

4. Content & Intellectual Property

All content in the App — including vocabulary data, audio recordings, lesson text, illustrations, and the city map — is owned by Kevin Davis or licensed to us. You may not copy, redistribute, or commercially exploit any App content.

5. User-Generated Content

When you use the AI photo import feature, you retain ownership of your photos. Photos are processed on our server and automatically deleted within 1 hour. We do not claim rights to your photos or the flashcards generated from them.

6. Acceptable Use

You agree not to:

Reverse-engineer, decompile, or disassemble the App
Use the App for any unlawful purpose
Attempt to circumvent subscription restrictions
Redistribute App content or audio files

7. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not guarantee that the App will be error-free, uninterrupted, or that all content is perfectly accurate.

8. Limitation of Liability

To the maximum extent permitted by law, Kevin Davis shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of California, United States.
